GENERAL TERMS & CONDITIONS
DURATION
The duration of the rent
starts and finishes according to the pick up & dropp-out dates detailed
on your confirmation, except if a
prolongation is accepted by the renter out.
Failing restitution of the vehicle at the end of convened period,
the renter out has the right to take the vehicle back anywhere at the cost
of the hirer.
DRIVER
PROFILE
-
only one conductor : the one mentioned on the contract
- Minimum age : 21 with
driving licence of more than 2 years (A/B/C)
- For vehicles above
categories A/B/C : minimum age of 23 with driving licence of more than 3
years
HIRER's RESPONSIBILITIES
The hirer has the legal responsibility of the vehicle. He has, when he is
not driving, to lock the vehicle, put the alarm on, keep the vehicles
documents with him. He has also to take good care of the vehicle and park
it in a safe place and take the keys with him if the vehicle is not under
survey.
The hirer is
responsible for the vehicle whether in circulation or during parking.
He has not
the right to utilise it to transport paying people, pull or
push another vehicle, participate to car races, drive under
alcohol, medicines or any
other substances which influence
his capacity to drive, contravene to driving regulations.
TOWING FEES TO A GARAGE
For all
vehicle outside the renting zone, the hirer will have to pay return fees,
calculated under a mileage cost per
category and distance between the return and starting points.
Should the hirer not return the vehicle documents, equipments or
accessories, the rental will continue until the above mentioned is
returned or until he can produce a report mentioning the theft/loss.
The hirer will have to pay for the renewal of the documents or the
repair of accessories. The
official theft report must be done to the police or the
"gendarmerie" by the persons mentioned on the rental contract.
As soon as the rental contract is signed, the hirer recognises that the
vehicle is in good condition and with no apparent default.
He then engages himself to return the vehicle in the same condition
including the keys at the time mentioned on the contract.
Should the hirer want to make reserves about the vehicle
conditions, he should make them upon signature of the contract.
Some renters out give the vehicle with a partially filled in tank.
The hirer will give the vehicle back with the same level of petrol
in the tank. Should
there be more petrol upon return, there won't be any refund.
EXONERATIONS &
RESPONSIBILITIES
The hirer won't be able
to claim against the renter out in case of loss or damages to his personal
belongings left inside the vehicle. Within
legal limits, the renter out is not responsible for damages to the hirer
or third party utilising the vehicle.
LITIGATIONS
Any
litigation which could occur will be submitted to the Moroccan law and
will depend on the Tribunal of Commerce of Marrakech, except otherwise
mentioned in the contract.
MAINTENANCE, REPAIRS, CONDITIONS
OF USE
The
hirer will check regularly oil, water and other fluids levels.
The normal maintenance of the vehicle must be done by the hirer in
a garage designated by the renter out.
Any other repairs will have to be done according to the renter
out's pre-authorisation.
PRICE
The
hirer will pay or reimburse the renter out upon his request :
a) daily basis rental, (24 hours non
sizeable) - unlimited mileage and TVA included
b) extra cost if additional
driver, petrol in the tank or refill, delivery expenses, driver, optional
insurance,
c) return fees if the vehicle
is returned in another town according to tariffs when signing the
contract,
d) all legal expenses or fines
incurred by the hirer during utilisation of the vehicle.
Repair
expenses will only be covered if a report signed by the two parties
incurred is signed and remitted to the police or the
"gendarmerie" within 48 hours.
The theft or
alteration of the vehicle must be declared to the police or the
"gendarmerie" with handing the keys over.
Failing producing these documents will entail the non payment by
the insurances of the expenses incurred and the hirer will have to pay the
full amount of repairs to the renter out.
At the end of
rental, the balance due must be settled within 48 hours.
Failing this, the hirer will have to pay to the renter out the
suing fees incurred by the renter out to get the money due (including
advocates fees) + interests + an indemnity of 20% of the remaining amount
of money due.
PRICE SETTLEMENT
The
hirer will follow the contract clauses and will in anyway
-
pay an instalment upon reservation of 10 to 20%, unless reservation
at less than 5 days notice ;
- 75% of the rental must
be paid upon reception of the vehicle.
The rental is
payable in cash - Dirham or currency - cable transfer or credit card.
Payment with credit card may create additional cost of 4% above the price
(Visa card commission).
GUARANTEE
If the
customer is not a regular customer of the renter out or if he has not a
credit card, he will have to provide the proof of his solvability as well
as a residence proof.
A guarantee depending upon the category of the rented vehicle will be
taken and given back upon return of the vehicle if all the contract
clauses have been respected.
DAMAGES
If all terms
and conditions of the contract have been respected by the hirer, his
responsibility in case of theft or loss of vehicle, damage to equipments
or accessories,
a)
is limited to the accidental damage excess mentioned on the first
page of the contract in case of a comprehensible & widespread
insurance with redeemable accidental
damage excess;
b)
is unlimited if basic insurance only.
In case of
intentional fault or important negligence, (for example : abandon of the
vehicle without any check with the keys inside the car) of the hirer, this
is considered as aggravating facts in case of loss or theft of the vehicle
or its equipments or accessories.
